1. Acceptance of Terms

By accessing or using our website and its related online features (collectively, the “Website Services”), you agree to these Terms of Use (“Terms”). These Terms constitute a legally binding agreement between you and ProTime Painting.

If you do not agree to these Terms, you must not use the Website Services. Your continued use of the Website Services after updated Terms are posted constitutes your acceptance of those changes.

These Terms govern use of our website. Painting projects and related services may be subject to separate estimates, proposals, contracts, warranties, or other written agreements. If these Terms conflict with a signed project agreement, the project agreement will control with respect to that project.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to submit a request, approve an estimate, or enter into an agreement through the Website Services.

By using the Website Services, you represent that you meet these requirements and have the legal authority to agree to these Terms. If you use the Website Services on behalf of a business or another person, you represent that you are authorized to bind that business or person.

3. Use of the Website Services

3.1 Permitted Use

You may use the Website Services only for lawful purposes and in accordance with these Terms.

Information submitted when requesting an estimate, scheduling a consultation, or contacting us must be accurate and complete to the best of your knowledge.

3.2 Prohibited Activities

You may not:

  • Attempt to gain unauthorized access to the Website Services, servers, accounts, or related systems.
  • Interfere with or disrupt the operation or security of the Website Services.
  • Introduce viruses, malicious code, or other harmful technology.
  • Use automated systems to scrape, copy, or extract content without our written permission.
  • Attempt to reverse-engineer or obtain source code from the Website Services, except where permitted by law.
  • Impersonate another person or misrepresent your identity or authority.
  • Submit false, fraudulent, misleading, or unlawful information.
  • Use the Website Services to violate any applicable law or regulation.
  • Use our name, branding, or content in a manner that suggests an unauthorized relationship with or endorsement by ProTime Painting.

4. Estimates and Service Information

Requests submitted through our website do not create a binding service agreement or guarantee availability.

Website descriptions, photographs, examples, promotions, and general pricing information are provided for informational purposes. Actual project pricing, timing, scope, materials, and warranty coverage may vary based on an on-site assessment and the terms of a written estimate or contract.

An estimate or proposal becomes binding only when accepted in accordance with its stated terms. Project-specific payment terms, cancellation rules, change-order procedures, warranties, and other conditions will be governed by the applicable estimate, proposal, or service agreement.

5. Intellectual Property

Unless otherwise stated, the Website Services and their content—including text, photographs, graphics, logos, designs, videos, and software—are owned by or licensed to ProTime Painting and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, and non-transferable license to access and use the Website Services for lawful personal or internal business purposes.

Without our prior written permission, you may not reproduce, modify, distribute, sell, license, publicly display, or create derivative works from our website content, except as permitted by law.

6. User-Submitted Content

You may provide reviews, feedback, photographs, project information, or other content to us. You retain ownership of content you submit.

When you intentionally submit content for publication or promotional use, you grant ProTime Painting a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for operating and promoting our business, subject to applicable law and any separate agreement with you.

You represent that:

  • You own the submitted content or have permission to provide it.
  • The content is accurate and lawful.
  • Our permitted use of the content will not violate another person’s rights.

Submitting confidential project details through a public review or social-media feature is discouraged.

7. Third-Party Links and Services

Our website may contain links to or integrations with third-party websites and services, including mapping, payment, scheduling, social-media, review, and analytics providers.

We do not own or control these third parties and are not responsible for their availability, content, security, terms, or privacy practices. Your use of a third-party service is governed by that provider’s applicable terms and policies.

8. Disclaimer of Warranties

To the fullest extent permitted by law, the Website Services are provided on an “as is” and “as available” basis.

We make no guarantee that the Website Services will always be available, uninterrupted, secure, accurate, current, or free from errors or harmful components. We disclaim all implied warranties relating to the Website Services, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

This section applies to our Website Services. Any warranties covering painting or other project services will be stated in the applicable written estimate, contract, or warranty document.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

9. Limitation of Liability

To the fullest extent permitted by law, ProTime Painting and its owners, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of—or inability to use—the Website Services.

To the fullest extent permitted by law, our total liability arising from the Website Services will not exceed the greater of:

  • The amount you paid specifically to access the Website Services during the six months preceding the event giving rise to the claim; or
  • One hundred dollars ($100).

These limitations do not apply where prohibited by law. Liability relating to an actual painting project may be governed by the applicable project agreement and applicable law.

10. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless ProTime Painting and its owners, employees, contractors, representatives, and affiliates from claims, damages, losses, liabilities, and expenses arising from:

  • Your unlawful or unauthorized use of the Website Services.
  • Your violation of these Terms.
  • Content you submit through the Website Services.
  • Your violation of another person’s rights.

11. Suspension and Termination

We may suspend, restrict, or terminate your access to the Website Services if we reasonably believe you have violated these Terms, misused the Website Services, or created a security or legal risk.

Upon termination, your right to use the Website Services will end. Provisions that should reasonably survive termination—including provisions concerning intellectual property, disclaimers, liability, indemnification, and dispute resolution—will remain effective.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.

Before filing a formal claim, you and ProTime Painting agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the dispute and requested resolution. Notices to ProTime Painting must be sent to info.ptpwichita@gmail.com.

If the dispute is not resolved informally, either party may pursue available remedies in accordance with applicable law. Unless the parties agree otherwise or applicable law requires a different location, judicial proceedings relating to these Terms must be brought in a court with jurisdiction in Sedgwick County, Kansas.

13. Privacy

Our collection and use of personal information are governed by our Privacy Policy. By using the Website Services, you acknowledge that you have reviewed the Privacy Policy.

14. Changes to These Terms

We may update these Terms periodically to reflect changes in our Website Services, business practices, or legal obligations.

Updated Terms will be posted on this page with a revised Effective Date. Your continued use of the Website Services after updated Terms are posted constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the greatest extent permitted by law. The remaining provisions will continue in effect.

16. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

17. Entire Agreement

These Terms constitute the entire agreement between you and ProTime Painting regarding use of the Website Services and replace prior understandings relating to that subject.

Separate estimates, proposals, contracts, and warranty documents govern painting projects and related services.
